Welcome to Bharat Yogavidya Kendra (BYK). By accessing or using our services, including participation in our courses, workshops, or any online or in-person yoga sessions, you agree to be bound by the following terms and conditions. These terms outline the guidelines, policies, and responsibilities governing your use of BYK’s services.

Please read them carefully before engaging with our offerings to ensure that you fully understand your rights and obligations. BYK reserves the right to modify these terms and conditions at any time without prior notice. By continuing to use our services after any changes are made, you agree to be bound by the revised terms.
 

Our services are designed to provide enriching and safe experiences for all participants. As part of this commitment, we have established policies related to cancellations, refunds, health considerations, and the use of our intellectual property. These policies are intended to protect the interests of both our participants and the organization, while ensuring the highest standards of quality and service. Health and Medical Disclaimer


By participating in any yoga classes, courses, workshops, or programs provided by Bharat Yogavidya Kendra (BYK), whether in-person or online, you acknowledge that you have read, understood, and agree to the following health and medical disclaimer:
 

Consultation with a Medical Professional:

The yoga practices, exercises, and wellness programs offered by BYK are not substitutes for professional medical advice, diagnosis, or treatment. You are strongly advised to consult with a physician or qualified healthcare provider before beginning any new exercise program, including yoga, to ensure that it is suitable for your specific health conditions, fitness level, and medical history.
It is your responsibility to disclose any pre-existing medical conditions, injuries, surgeries, or limitations that may affect your ability to safely participate in yoga practices. BYK and its instructors are not responsible for any undisclosed medical conditions or any injuries or health complications arising from your failure to seek appropriate medical advice.

Voluntary Participation and Assumption of Risk:
By engaging in yoga practices or wellness activities offered by BYK, you voluntarily assume all risks associated with these activities. Yoga involves physical movement and exertion that may result in injury, including but not limited to muscle soreness, sprains, fractures, or aggravation of pre-existing conditions.
Participation in yoga classes, courses, or events is entirely voluntary, and you accept full responsibility for your actions, choices, and behaviors during the sessions.

No Medical Supervision:
BYK yoga instructors are experienced in guiding yoga and wellness practices but are not healthcare providers. They are not qualified to diagnose medical conditions, prescribe treatment, or offer specialized medical advice.
The instructions provided during classes are general in nature and not tailored to any individual's specific health requirements. If you experience pain, discomfort, or any unusual symptoms during a class, you are encouraged to stop immediately and seek medical attention.

Physical Fitness and Personal Responsibility:

You acknowledge that it is your responsibility to judge your own physical capabilities and limitations while performing any yoga practice. You should only practice yoga to the extent that you feel comfortable, and it is your duty to inform the instructor of any discomfort, limitations, or restrictions.
If you have any chronic health conditions, including but not limited to heart disease, high blood pressure, arthritis, or any other medical concerns, you should seek clearance from your physician before engaging in BYK’s yoga programs.

Injury and Liability Waiver:

BYK and its instructors, staff, or affiliates shall not be held liable for any personal injury, accident, or health complication that may occur as a result of your participation in any yoga, meditation, or wellness sessions.
You acknowledge and agree to release and discharge BYK from any claims, demands, or lawsuits that may arise from your participation, including claims related to negligence on the part of BYK or its instructors.

Modifications and Adaptations:

If you have any limitations or special needs, it is your responsibility to request modifications or adaptations to yoga poses or practices to ensure your safety and well-being. Instructors may offer suggestions but cannot provide personalized medical advice.
If you are pregnant or have recently undergone surgery, you must inform the instructor and seek medical advice before continuing with or modifying your yoga practice.

Breathing Practices and Meditation:

Breathing exercises (pranayama) and meditation are generally safe but should be performed with awareness. If you feel light-headed, dizzy, or experience any other adverse effects, you should stop immediately and consult a medical professional.

 

Online and Remote Sessions:

In online or remote sessions, you acknowledge that the instructor cannot provide the same level of observation or assistance as in-person classes. You agree to take additional care and be mindful of your physical limitations and surroundings to avoid injury.

Cancellation & Refund Policy

Bharat Yogavidya Kendra (BYK) is committed to providing high-quality yoga education and experiences. In alignment with this commitment, the following outlines our cancellation and refund policy:
 

  1. No Refund Policy: BYK adheres to a strict no-refund policy. Once fees are paid, they are non-refundable under standard circumstances.

  2. Course Adjustment Option: Participants have the option to adjust the paid amount against any other upcoming course offered by BYK. Alternatively, where feasible, access to course recordings may be provided as compensation.

  3. Exceptional Circumstances Refunds: Refunds may be considered only in exceptional circumstances and at the sole discretion of BYK. In such rare cases, only 50% of the paid fee will be refunded. Participants seeking an exceptional refund must submit a formal request to connect@bharatyogavidyakendra.in for consideration.

Refund Process:


To ensure clarity and efficiency in the refund process, the following steps will be followed:

  1. Refund Request Submission: Participants must submit their refund requests via email to connect@bharatyogavidyakendra.in.​

  2. Review and Approval: Upon receiving a refund request, BYK will review it within 48 hours. If the request is approved, the participant will be notified, and the request will be forwarded to the BYK Finance Team at mdpoffice@satsang-foundation.org.​

  3. Processing Schedule: Due to limited resources, refund requests are processed only on the 15th and 30th of each month.

Refund Timelines:
 

  • Local Refunds (within India): Processed within 72 hours of initiation.

  • International Refunds: May take 10 to 15 days due to the involvement of several layers of government approvals.​
    We request international participants to be patient as international refunds are subject to governmental approvals, which may cause delays.

Course Cancellation by BYK:

​

  1. Participants will be promptly notified via email.

  2. Alternative course date options will be offered. If participants agree, they will be moved to another course.

  3. If not, full course fee refunds will be processed as per Refund Process Timelines (stated above)

Minimum Registration Clause: We require a minimum of 5 registrations to conduct a course. If this number is not met, the course will be cancelled. Participants will have the option to receive a full refund or to transfer the fee towards another course or future batch of their choice.

Missed Classes, Sessions, and Carryover Policy:

​

We value each student's journey with us; however, to maintain fairness and consistency for all participants, we cannot offer carryovers for missed classes, sessions, or monthly enrollments. Missed time is non-transferable and cannot be made up in subsequent sessions or months. We understand that unforeseen circumstances may occur, so in the event of missing an online session, participants will have access to the session's Zoom recording for three days following the class to help stay on track. This policy ensures our commitment to providing a structured and comprehensive learning experience while accommodating individual needs as much as possible. For example, if you have registered for a 3-month course (April, May, June), and you are unable to attend classes in May, you can't carry over May fees to July. You cannot carryover the fees paid into another course either.

 

Online Services and Courses

Participation in online courses requires internet access and a device capable of streaming video content. BYK is not responsible for any technical difficulties that arise from user-side issues such as poor internet connection. Online course access may be terminated if participants engage in unlawful behavior, breach the terms of the platform, or misuse the services provided.
 

Intellectual Property 

All content on BYK’s website, social media, and class materials (including but not limited to texts, images, videos, and written guides) is the intellectual property of BYK or its content creators and is protected by copyright laws. No content from BYK may be reproduced, distributed, or used for commercial purposes without prior written consent.

Code of Conduct

Respect for fellow participants, instructors, and the space is mandatory. Disruptive or disrespectful behavior may result in removal from the class without refund. Participants should wear comfortable, appropriate clothing for physical activity

Limitation of Liability

BYK, its instructors, and staff are not liable for any personal injury, loss, or damage sustained by participants during in-person or online yoga sessions
 

Governing Law

These terms and conditions shall be governed by and interpreted in accordance with the laws of India, and you submit to the non-exclusive jurisdiction of the state and federal courts located in India.

Escalation Process​

If you have concerns or unresolved issues regarding the refund process, please follow our escalation procedure:

 

  1. Initial Escalation: If your concerns are not addressed satisfactorily, you may escalate the matter by writing to BYK Lead at vivek@bharatyogavidyakendra.in.

  2. Secondary Escalation: Should the issue remain unresolved, you may further escalate it to our Senior Management Team at secretary@satsang-foundation.org.

 

We aim to resolve all issues promptly and efficiently, adhering to the highest standards of customer service.

We appreciate your understanding and cooperation regarding our refund and escalation policies. These policies help us maintain the integrity and quality of our courses.

 

BYK reserves the right to revise the terms and conditions of this policy at any time and at our sole discretion.
